The purpose of this paper is to show how interdisciplinary studies between the fields of law and literature can contribute to the debate on legal interpretation, and to the role of what legal operators actually do when deciding constitutional issues. First, we will review one of the possible meeting points between law and literature - i. e. law as literature - and we will examine Roland Barthes’ semiological proposal, specifically his theory about “The Death of the Author”; from there on, (...) we will show how the ideas and concepts he coined constitute one of the tools that best describe the mechanics of the current constitutional interpretation in some legal systems. En este ensayo se revisa alguna literatura reciente sobre el realismo jurídico y en particular sobre el realismo jurídico escandinavo. Más adelante, se proponen también dos líneas de investigación adicionales. Se sugiere que los estudios históricos deben iluminar el realismo jurídico como parte de un cambio intelectual a largo plazo del pensamiento social occidental, un cambio precipitado por variaciones socioeconómicas, como la segunda revolución industrial, el desarrollo de la secularización, y la llegada del estado de bienestar regulador, así como por (...) transformaciones intelectuales tales como el avance del materialismo científico y el naturalismo. This paper analyses the details that characterized the negotiation and collection of the servicio de los naturales from the year 1603 onwards, the last time of those three in which moriscos of Granada paid to the Hispanic Monarchy after the Alpujarras War, when they were settled in Castile. The author has analysed documents coming from the Archivo General de Simancas, but also those included in notary’s protocols and in local archives. Its main contributions are three: to publish the content of (...) the actual contract signed by the moriscos and the Crown; to contribute to set up a precise spatial distribution of the communities that paid the tax and, finally, to show the amounts delivered by them. Irregularities, problems, and conflicts lived while the precedent servicios were being paid, are analysed too. There are aspects that we know thanks to other previous works. Nevertheless, if they are considered in relation with the situation of the year 1603, they allow observing that all those difficulties were used in order to improve the servicio itself and the agreement between the minority and the King. En el presente trabajo se sostienen toda una serie de tesis interrelacionadas. En primer lugar, se argumenta que el escepticismo y el pensamiento crítico no gozan de especial buena salud el ámbito de la teoría social. En segundo lugar, se sostiene que esto es también así a nivel social general. En tercer lugar, se discuten algunos mecanismos que pueden permitir explicar por qué el bullshit y el oscurantismo, y no el pensamiento crítico y el escepticismo, proliferan en ambos contextos. En (...) cuarto lugar, se abordan tres ámbitos donde la crisis del pensamiento crítico resulta especialmente grave, tanto a nivel social como académico: a saber, los movimientos ecologista, feminista y antirracista. En este caso, se defiende que no se trata tan solo de que el bullshit y el oscurantismo estén presentes en estos debates tanto en el campo académico como en el político, sino que existe una relación causal entre ambos ámbitos, así como un proceso de falsificación de preferencias que puede ser peligroso tanto para la libertad intelectual, como para la libertad de expresión y la salud de la democracia. A cien años de la publicación de A Treatise on Probability, de J. M. Keynes, este artículo indaga sobre su relevancia en la historia del concepto de “probabilidad”. Tras repasar el surgimiento y evolución del concepto moderno de “probabilidad” hasta principios del siglo XX, se identifica un punto nodal en la publicación del Ars Conjectandi de J. Bernoulli a principios de siglo XVIII, en donde se propuso de forma original tratar el campo completo de las conjeturas probables mediante el herramental (...) matemático de la doctrina de las posibilidades. El artículo busca comprender el Treatise keynesiano como una reacción a dicho proyecto encarnado en el siglo XVIII por la escuela clásica laplaciana y en el XIX por la escuela frecuentista. Tras presentar los principales argumentos de Keynes en contra de la concepción de la probabilidad como una entidad necesariamente medible y, por ende, tratable mediante el herramental matemático de la doctrina de las posibilidades, se extraen reflexiones sobre la relevancia y actualidad del Treatise. The ultimate source of explanation in biology is the principle of natural selection. Natural selection means differential reproduction of genes and gene combinations. It is a mechanistic process which accounts for the existence in living organisms of end-directed structures and processes. It is argued that teleological explanations in biology are not only acceptable but indeed indispensable. There are at least three categories of biological phenomena where teleological explanations are appropriate.

(1908-1990) integra-se em uma directriz que aponta para a valorização do pensamento português, um dos objectivos precípuos da Revista Portuguesa de Filosofia, de que aquele foi colaborador. Pode definir-se o alcance da tese que está subjacente aos estudos de M. Martins: - a existência du. duma constante no Homem, quando este é considerado globalmente, como ser vivo e senhor de sentimentos e de aspirações em larga medida comuns a todos os tempos. Os termos (...) em que o homem medieval experimentou e desenvolveu tão complexa teia de relações na sua época - de ideias, de gostos, de crenças, de volições e de vivências, e sobre aquela, nos textos quenos legou pôde reflectir em plano. especulativo - tal foi o objecto prioritário da diuturna inquirição do nosso Autor. Tese essa que supõe, para conveniente compreensão e tratamento dos temas, se reconheça a funcionalidade interdisciplinar dos agentes da cultura. É esta noção que leva M. Autor de vastíssima bibliografia no campo da cultura portuguesa, e especialmente em seu âmbito medieval, M. Martins apresenta-se como o historiador das inter-relações, em termos, amplitude e alcance antes desconhecidos, como chave de interpretação da cultura medieval, com novas modalidades de tratamento e de exegese de textos o que conduz a uma necessária revisão de conceitos na actual historiografia portuguesa. M. Martins' contribution can be seen in his insistence that there is a constant factor in the existence of Man. His rechearch into Medieval texts attemps to bring this factor out; the key notion is the interdisciplinary functioning of cultural agents. M. Martins releas, thus, to a comparative methodology, giving special emphasis on interrelationships; diverse philosophical doctrines, historical sources, tradional myths and legends archetypes revealed in arcajc poetry, popular novelas, etc. What we find is avast network of spirituality that brings together East and West, Antiquity and the Middle Ages, the Middle Ages and our oun times. As historica of interrelationships, M. Martins' work can contribute to the need revision of concepts in current Portuguese historical studies. Unpublished letters and bibliography of the author can be found in apendix. These reveal the personality traits and the central themes of this medievalist. (shrink)

The sociobiologists' argument is that human ethical norms are sociocultural correlates of behaviors fostered by biological evolution. I argue that such proposals are misguided and do not escape the naturalistic fallacy. The isomorphism between the behaviors promoted by natural selection and those sanctioned by moral norms exist only with respect to the consequences of the behaviors; the underlying causations are completely disparate. This article identifies a double allusion to the tragic characters of Phaedra and Eriphyle in Amm. Marc. 14.1.3 and considers its possible meanings. In combination, these allusions evoke the double nature of the story of Eriphyle, therefore functioning as a reference to the double nature of Caesar Gallus’ depiction in Ammianus. The double allusion consequently forms part of Ammianus’ tragic style throughout Book 14. Having identified the presence of this double allusion, the article illuminates its possible meaning by connecting Ammianus’ (...) passage to the Virgilian rewriting of the description of Eriphyle in Homer. Knives, birds' wings, and mountain slopes are used for certain purposes: cutting, flying, and climbing. A bird's wings have in common with knives that they have been 'designed' for the purpose they serve, which purpose accounts for their existence, whereas mountain slopes have come about by geological processes independently of their uses for climbing. A bird's wings differ from a knife in that they have not been designed or produced by any conscious agent; rather, the wings, like the slopes, are (...) outcomes of natural processes without any intentional causation. Evolutionary biologists use teleological language and teleological explanations. I propose that this use is appropriate, because teleological explanations are hypotheses that can be subject to empirical testing. The distinctiveness of teleological hypotheses is that they account for the existence of a feature in terms of the function it serves; for example, wings have evolved and persist because flying is beneficial to birds by increasing their chances of surviving and reproducing. Features of organisms that are explained with teleological hypotheses include structures, such as wings; processes, such as development from egg to adult; and behaviours, such as nest building. A proximate explanation of these features is the function they serve; an ultimate explanation that they all share is their contribution to the reproductive fitness of the organisms. I distinguish several kinds of teleological explanations, such as natural and artificial, as well as bounded and unbounded, some of which but not others apply to biological explanations. (shrink)

Resumen Defiendo que lo novedoso de la concepción de Cicerón de los modelos basados en personajes del pasado consistió en conferirles habilidades que podían aplicarse a las disputas legales y políticas de Roma y, al mismo tiempo, mejorar el desempeño de los oradores jóvenes y aprendices mediante un modelo mixto de retórica. La destreza técnica y la prudencia práctica de estas autoridades para advertir aspectos cruciales en casos particulares y adaptarse a circunstancias adversas sirven como ejemplos para los oficios del (...) rétor y del abogado. Esas dos características, y no el amplio conocimiento o la fama que estos personajes alcanzaron, llevaron a Cicerón a reconocer a ciertos oradores y pensadores como fuentes de inspiración moral y formativa.I argue that Cicero's innovative understanding of the models based on characters from the past consisted in conferring them skills to be applied in the legal and political disputes of Rome and, at the same time, to improve the performance of young orators and apprentices with a mixed model of rhetoric. Both the technical ability and practical prudence of these authorities to see crucial aspects in particular cases and to adapt to adverse circumstances serve to the craft of rhetoricians and lawyers. These two features, and not the large knowledge or fame these figures acquired in life, took Cicero to recognise certain orators and thinkers as sources of moral and formative inspiration. (shrink)

_Dialectic and Dialogue_ seeks to define the method and the aims of Plato's dialectic in both the "inconclusive" dialogues and the dialogues that describe and practice a method of hypothesis. Departing from most treatments of Plato, Gonzalez argues that the philosophical knowledge at which dialectic aims is nonpropositional, practical, and reflexive. The result is a reassessment of how Plato understood the nature of philosophy.

Transitaremos así de la interpretación de la filosofía leibniziana del sujeto como un «manierismo» que ofrece Deleuze a la caracterización graciana del héroe y el mundo, con miras a mostrar que en (...) ambos planteamientos hay una ontología de la potencia que desmiente el esencialismo a propósito del sujeto característico de la Modernidad de cuño cartesiano, en provecho de una evaluación interna o inmanente del sujeto conformada en tiempos de crisis y con una marcada inspiración estoica. I will, first, outline what we currently know about the last 4 million years of human evolutionary history, from bipedal but small‐brained Australopithecus to modern Homo sapiens, our species, through the prolific toolmaker Homo habilis and the continent wanderer Homo erectus. I shall then identify anatomical traits that distinguish us from other animals and point out our two kinds of heredity, the biological and the cultural.Biological inheritance is based on the transmission of genetic information, in humans very much the same (...) as in other sexually reproducing organisms. But cultural inheritance is distinctively human, based on transmission of information by a teaching and learning process that is in principle independent of biological parentage. Cultural inheritance makes possible the cumulative transmission of experience from generation to generation. Cultural heredity is a swifter and more effective (because it can be designed) mode of adaptation to the environment than the biological mode. The advent of cultural heredity ushered in cultural evolution, which transcends biological evolution.I will, finally, explore ethical behavior as a model case of a distinctive human trait, and seek to ascertain the causal connections between human ethics and human biology. My conclusions are that (1) moral reasoning—that is, the proclivity to make ethical judgments by evaluating actions as either good or evil—is rooted in our biological nature; it is a necessary outcome of our exalted intelligence, but (2) the moral codes that guide our decisions as to which actions are good and which ones are evil are products of culture, including social and religious traditions. This second conclusion contradicts those evolutionists and sociobiologists who claim that the morally good is simply that which is promoted by the process of biological evolution. (shrink)

This paper sets forth a familiar theme, that science essentially consists of two interdependent episodes, one imaginative, the other critical. Hypotheses and other imaginative conjectures are the initial stage of scientific inquiry because they provide the incentive to seek the truth and a clue as to where to find it. But scientific conjectures must be subject to critical examination and empirical testing. There is a dialogue between the two episodes; observations made to test a hypothesis are the inspiration for new (...) conjectures. Inductive generalizations may also inspire hypotheses, but cannot validate them. A hypothesis is empirically tested by ascertaining whether or not predictions about the world of experience deduced from the hypothesis agree with what is actually observed. This has been appropriately considered the 'criterion of demarcation' that distinguishes science from other knowledge. But scientific hypotheses must satisfy other tests as well, e.g., whether they have explanatory value and further understanding. I briefly explore such issues as verifiability and falsifiability, empirical content and truthfulness, contingency and certainty, fact and theory, error and fraud. Science like any human activity is subject to error and to the foibles and other failings of human beings. But severe attempts of empirical falsification and other trials yield knowledge that stands the test of time and provides a foothold for further knowledge. Moreover, scientists have developed social mechanisms, such as peer review and publication, to evaluate their work. Because the research of scientists depends on the validity of previous knowledge, it is of great consequence that they discern valid from invalid knowledge and thus scientists are inclined to transcend ideology, nationality, friendship, monetary interest and other prejudices when the mettle of scientific knowledge is at stake. I use historical examples to illustrate some relevant aspects of scientific practice: its success (Mendel), misrepresentation (Darwin), ideological abuse (Lysenko), arrogant violation of the requirement of testing (Koch), theory replacement (Priestly and Lavoisier, Newton and Einstein), and the indispensability of context (Oswald Avery and Alfred Wegener). Stephen Jay Gould’s monumental The Structure of Evolutionary Theory ‘‘attempts to expand and alter the premises of Darwinism, in order to build an enlarged and distinctive evolutionary theory . . . while remaining within the tradition, and under the logic, of Darwinian argument.’’ The three branches or ‘‘fundamental principles of Darwinian logic’’ are, according to Gould: agency (natural selection acting on individual organisms), efficacy (producing new species adapted to their environments), and scope (accumulation of changes that through geological time yield (...) the living world’s panoply of diversity and morphological complexity). Gould’s efforts to contribute something important to each of these three fundamental components of Darwinian Theory are far from successful. (shrink)

My purpose in this article is to propose an explicitly naturalized account of the experience of present nowness on the basis of two complementary sources: phenomenological analysis and cognitive neuroscience. What I mean by naturalization, and the role cognitive neuroscience plays will become clear as the paper unfolds, but the main intention is to use the consciousness of present time as a study case for the phenomenological framework presented by Depraz in this Special Issue.

In _Ecological Ethics and the Human Soul: Aquinas, Whitehead, and the Metaphysics of Value_, Francisco J. Benzoni addresses the pervasive and destructive view that there is a moral gulf between human beings and other creatures. Thomas Aquinas, whose metaphysics entails such a moral gulf, holds that human beings are ultimately separate from nature. Alfred North Whitehead, in contrast, maintains that human beings are continuous with the rest of nature. These different metaphysical systems demand different ethical stances toward creation. Benzoni (...) analyzes and challenges Thomas's understanding of the human soul, his primary justification for the moral separation, arguing that it is finally philosophically untenable. The author finds promising the alternative metaphysics of Whitehead, for whom human beings are a part of nature—even if the highest part; all creatures have a degree of subjectivity and creativity, and thus all have intrinsic value and moral worth, independent of subjective human valuation. Further, though there is difference, there is no moral gulf between God and the world. God is truly affected by the experience of creatures. In this article, I will try to elucidate the relevance of Deleuze and Guattari’s approaches in the philosophy of education, along the lines of the Deleuzean pedagogy of ‘do with me’ and the absence of pre-established rules for learning or methodological anarchism. To do so, I will consider three important milestones in Deleuze and Guattari’s thought: (i) antihumanism as the matrix of a pedagogy of generosity, (ii) the primacy of functioning over meaning as a vindication of practical learning versus rote (...) learning, (iii) the concepts of ‘deterritorialisation-reterritorialisation’ as the unlearning required by all true learning. La clonación de humanos puede también referirse a clonación terapéutica o de individuos. Se han avanzado propuestas sugiriendo clonar individuos de gran capacidad intelectual o artística, o de virtud eminente. Tales propuestas utópicas son sumamente desafortunadas. No es posible clonar un individuo humano, aun si se clona su genoma. De genomas idénticos, desarrollados en contextos diferentes, familiares, sociales y culturales, pueden resultar individuos totalmente diferentes. Their discoveries brought about a fundamental revolution, namely a commitment to the postulate that the universe obeys immanent laws that can account for natural phenomena. The workings of the universe were brought into the realm of science: explanation through natural laws. Darwin completed the Copernican revolution by extending it to the living world. Darwin demonstrated the evolution of organisms. (...) More important yet is that he discovered natural selection, the process that explains the ‘design’ of organisms. The adaptations and diversity of organisms, the origin of novel and complex species, even the origin of mankind, could now be explained by an orderly process of change governed by natural laws. Varela Bernhard Poerksen Institut für Journalistik und Kommunikationswissenschaft Universität Hamburg Francisco J. Varela (1946-2001) studied biology in Santiago de Chile, obtained his doctorate 1970 at Harvard University with a (...) dissertation on the insect eye, and worked there for some time in the laboratory of Torsten Wiesel, the later Nobel Laureate for medicine. From his scientific beginnings as a researcher in biology, he not only studied and practiced biology but, resisting the dominating mainstream, pursued a research program that ignored and broke down traditional disciplinary boundaries. This research program is best characterized as experimental epistemology, a concept introduced by the neuropsychiatrist and cybernetician Warren S. McCulloch. Francisco J. Varela's great aspiration was to examine and answer the philosophical ur-question of cognition with scientific precision and with the help of the best possible theoretical framework. Varela rejects the fundamental dualism dividing mind and world, which had shaped Western philosophy from its earliest beginnings. He equally distances himself, however, from the diametrically opposite position that overstates the eigenpower of the world of objects. Thinking and perceiving are understood as data processing in the sense that an independent external world is computationally transformed into symbols and represented in the organism in this manner. William Paley ( Natural Theology , 1802) developed the argument-from-design. The complex structure of the human eye evinces that it was designed by an intelligent Creator. The argument is based on the irreducible complexity ("relation") of multiple interacting parts, all necessary for function. Paley adduces a wealth of biological examples leading to the same conclusion; his knowledge of the biology of his time was profound and extensive. Charles Darwin’s Origin of Species is an extended argument demonstrating that the "design" of (...) organisms can be explained by natural selection. Moreover, the dysfunctions, defects, waste, and cruelty that prevail in the living world are incompatible with a benevolent and omnipotent Creator. They come about by a process that incorporates chance and necessity, mutation and natural selection. In addition to science, there are other ways of knowing, such as art, literature, philosophy, and religion. Matters of value, meaning, and purpose transcend science. (shrink)
